Terms of Service

These Terms of Service ("Terms") govern your use of the Chili'd mobile application and related services (the "Service"), operated by [Chili'd LLC / Spencer Russo] ("Chili'd," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to create an account. If you are under 18, you represent that a parent or legal guardian has reviewed and accepted these Terms on your behalf.

"User Content" means anything you post or upload to the Service, including check-in photos, chili names, venue names, ratings, heat levels, and notes.

We may remove User Content and suspend or terminate accounts that violate these Terms, with or without notice.

Zero tolerance for objectionable content

There is no tolerance for objectionable content or abusive users on Chili'd.

Reporting. Every check-in, comment, and profile has a Report action. Reports are anonymous โ€” the person you report is not told who reported them.

Our commitment. We review every report and act on it within 24 hours. Acting may mean removing the content, warning the account, suspending it, or permanently banning it.

Blocking. You can block any account from its profile. A blocked account cannot find you in search, see your bowls, comment on them, or follow you, and you will not see theirs. Blocking is not disclosed to the person blocked. Manage blocked accounts under Settings โ†’ Privacy โ†’ Blocked accounts.

5. Restaurant and chili information

Information about restaurants and chilis on Chili'd is contributed by users and aggregated from third-party sources (such as Google Maps). We do not verify every entry. Restaurant addresses, hours, menus, and other details may be inaccurate or out of date. Use this information at your own discretion.

6. Food safety disclaimer

Chili'd does not vet ingredients, allergens, sanitation standards, or food preparation practices at any restaurant. If you have a food allergy or sensitivity, do not rely on Chili'd to determine whether a food is safe for you to eat. Always verify ingredients with the restaurant directly.

7. Intellectual property

The Chili'd app, including the name "Chili'd," our logos, design, and code, is owned by Chili'd and protected by copyright, trademark, and other laws. You may not use our trademarks without our prior written permission.

8. Third-party services

The Service includes content and links to third-party services (Google Maps, restaurant websites, etc.). We are not responsible for those services' content, privacy practices, or availability.

9. Termination

You can stop using the Service and delete your account at any time from the Settings screen. We can suspend or terminate your access if you violate these Terms or if your continued use poses a risk to Chili'd or our users.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or quiet enjoyment. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected.

11. Limitation of liability

To the fullest extent permitted by law, Chili'd and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us in the past 12 months, or (b) ten U.S. dollars ($10).

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Chili'd from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be resolved in the state or federal courts located in [County, State], and you consent to personal jurisdiction in those courts.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the app or by email. Your continued use of the Service after changes take effect means you accept the updated Terms.
